What Does It Mean to Be Charged with Drug Possession?
In the state of New York, drug possession is defined as knowingly and unlawfully possessing a controlled substance. Under New York law, there are two types of drug possession: actual possession and constructive possession.
- Actual possession refers to a situation in which the drugs are found on your person.
- Constructive possession refers to a situation in which the drugs are found somewhere you have control over, such as your car or house.
It is important to note that you can still be charged with drug possession even if you do not own the drugs. For example, if the drugs were found in your car, you may be charged with drug possession, even if the drugs belonged to a friend.
If you have been arrested for drug possession, it is crucial to remember that you have rights. It is in your best interest to exercise your right to remain silent and contact an experienced drug possession defense lawyer as soon as possible.
